Terms of Service

These terms govern your use of the XMLExpress platform. By creating an account, uploading payroll data, or exporting XML through the service, you agree to be bound by them.

Disclaimer of Legal and Compliance Advice

XMLExpress operates strictly as a data formatting and conversion utility. We are not a law firm, accounting firm, or compliance advisory service. The software is designed to format user-provided data into XML structures compatible with third-party government portals (including, but not limited to, AASHTOWare and LCPtracker). XMLExpress makes no representations or warranties regarding the legal accuracy, completeness, or Davis-Bacon Act compliance of the data you submit.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XMLEXPRESS, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF CONTRACTS, BUSINESS INTERRUPTION, OR ANY FINES, PENALTIES, OR ASSESSMENTS LEVIED BY THE DEPARTMENT OF LABOR (DOL) OR ANY OTHER GOVERNMENT AGENCY.

User Responsibility

You explicitly acknowledge and agree that you are solely responsible for the accuracy of the payroll data uploaded to XMLExpress and for verifying the generated XML files before submission to any government portal. XMLExpress shall bear no liability for XML file rejections, delayed payments, audit failures, or termination of government contracts resulting from inaccurate source data, portal downtime, or changing agency schema requirements. Your use of the service constitutes your agreement to assume all risk associated with certified payroll compliance.

AI-Assisted Column Mapping

When our deterministic column matcher cannot recognize a CSV header, XMLExpress may use an AI model (Anthropic's Claude) to suggest which payroll field the header corresponds to. Only the header text itself is shared with the model — never wages, hours, employee names, SSNs, or any other payroll values, and the model's provider does not train on this data. AI suggestions are exactly that: suggestions. They are presented for your review in the mapping screen and are never applied without your approval, and you remain responsible for confirming that every approved mapping is correct before generating XML.
